Police: Cortland County man drove drunk with 1-year-old in car

CORTLAND — Police have charged a Cortland County man who they say was driving drunk with a 1-year-old in the car.

Sheriff’s officers stopped an SUV Sunday night just before 9 p.m. on Clinton Street Extension in Cortland.

Officers say Thomas Marks, 27, of Cuyler was intoxicated and in possession of hypodermic needles.

He’s been charged under Leandra’s Law, which makes it an automatic felony if you are charged with driving drunk with anyone under the age of 15 in the car.

Other misdemeanors and violations include: DWI, DWI with a BAC Greater than 0.08%, Endangering the Welfare of a Child, Possession of a Hypodermic Instrument, Failed to Keep Right, Unsafe Tire, Inadequate Stop Lamp, Driving While Intoxicated, Consumption of Alcohol in a Motor Vehicle, Unlicensed Operator, Aggravated Unlicensed Operation 3rd.

The child was not injured, and was turned over to a parent. Marks was arraigned in city court and taken to the Cortland County Jail.
