Homeless Cortland man charged in alleged menacing incident


CORTLAND, NY (CortacaToday) – An allegedly stolen garbage can leads to a felony arrest in Cortland.

The Cortland Police Department responded to Commando Avenue around 12:41 p.m. Tuesday, August 13, 2024, for a report of menacing involving a firearm.

Officers say three people living at the residence on Commando Ave searched and found their missing garbage container in a nearby homeless encampment, located in a heavily wooded area behind 30 Kellog Road. Multiple people were at the encampment.

During an argument about the trash can, 42-year-old Joshua Marshall allegedly pointed a rifle at the trio and threatened to shoot them if they didn’t leave. Police responded and located the encampment with the help of a drone. Officers were able to clear the encampment safely around 3:25 p.m., and a scoped pellet rifle was recovered at the scene.

Marshall was arrested after a short struggle and charged with felony criminal possession of a weapon, and misdemeanors of menacing and obstructing governmental administration. He was remanded to Cortland County Jail.

Marshall is set to appear in Cortland City Court on Friday, August 16, at 1:15 p.m.
